The Government says it intends to remove or amend a provision of the Anti-Corruption (Amendment) Bill that the Supreme Court determined cannot become law in its present form without a referendum.

The Supreme Court determined that Clause 17 is inconsistent with Article 4(c) of the Constitution and, in its present form, would require the special majority specified under Article 84(2) as well as approval by the people at a referendum under Article 83.

Cabinet spokesman Nalinda Jayatissa said the Government does not intend to pursue a referendum for the provision.

Instead, the clause may be amended at Committee Stage in a constitutionally compliant form or removed.

The parliamentary debate is scheduled for October 8.

Other provisions of the Bill are subject to different constitutional requirements, including simple-majority or special-majority requirements depending on the provision and any amendments made.

The Government's announced intention does not itself amend the Bill.

The final text must be checked when Parliament considers the legislation.
