Sri Lanka's Cabinet has approved a proposal to sign a bilateral agreement with South Korea on mutual legal assistance in criminal matters, strengthening formal cooperation in cross-border criminal investigations and prosecutions.
The agreement is intended to create a framework through which the two countries can assist each other in obtaining and exchanging material required for criminal proceedings.
Gathering evidence across borders
Mutual legal assistance arrangements allow one state to formally request assistance from another in matters such as gathering evidence, serving judicial documents and exchanging information required for criminal investigations or prosecutions.
Such agreements are particularly relevant when evidence, witnesses, documents or other material connected with a criminal investigation are located outside the investigating country.
Proposal dates back to 2023
The initiative for a Sri Lanka-South Korea mutual legal assistance agreement was originally proposed in 2023.
However, the agreement had not been concluded.
Cabinet has now approved proceeding with the signing of the bilateral agreement.
Not the same as a conviction or extradition decision
Mutual legal assistance provides mechanisms for cooperation between authorities.
It does not itself determine whether a person is guilty of an offence and should not be confused with a court judgment.
It also should not automatically be described as an extradition agreement unless separate extradition provisions are independently established.
